OCM Secures Summary Judgment Against Overzealous Condominium Association
OCM attorneys Joseph Calandrelli and David Mack successfully defeated a lawsuit that attempted to give more support to the old adage, “No good deed goes unpunished.” When OCM’s client allowed a disadvantaged youth to reside in a condominium unit he owned for free while she finished her collegiate studies, he never thought his act of charity would result in close to $100,000 in fines and a multi-year lawsuit brought by the condominium association. The association, despite being informed about the particular living circumstances, alleged that the arrangement violated the association’s rules against multi-year leases to non-family members. Attorneys Calandrelli and Mack successfully demonstrated for the Court that the living arrangement was a license, not a lease, and was not subject to the prohibition the association was attempting to enforce. The Court entered summary judgment in favor of OCM’s client and invalidated all of the fines the association had assessed against the unit.
