Sean Carnathan Publishes 2nd Edition of Massachusetts Bad Faith Insurance Litigation
OCM partner Sean Carnathan published the second edition of his book Massachusetts Bad Faith Insurance Litigation. The book provides a complete guide to bad faith insurance cases under M.G. L. Chapter 176D. Sean provides a history of bad faith law in Massachusetts, a comprehensive analysis of the statute (as well as related basis for suits), and a helpful discussion of first party vs. third party claims. A seasoned litigator, Sean walks readers through practical issues such as the demand letter, the statute of limitations, pleadings, discovery, typical evidentiary problems, common and less common insurer defenses, how to use experts, interest and attorney fee awards, appeals and more. The second edition updates the case law through year end 2019, expands the discovery chapter and discusses in detail the most significant recent court decisions.
